Non-eligibility for assistance

(1)
In this section,
“reserve”
means a reserve as defined in the
Indian Act
(Canada).
(réserve)

(2)
A person is not eligible to apply for assistance or to receive assistance, directly or indirectly, if the person
(
a
)
is not a resident of New Brunswick,
(
b
)
is not legally authorized to reside in Canada,
(
c
)
is a resident of a reserve,
(
d
)
is incarcerated in a penitentiary or a provincial jail, or
(
e
)
falls within a class prescribed by regulation.
